Fitzpatrick Dealership Group, together with its affiliated dealerships — Valley Lexus, Valley BMW, Valley Kia of Modesto, and Coliseum Lexus of Oakland (collectively, “FDG,” “we,” “us,” or “our“) — respects your privacy. This Privacy Policy explains what personal information we collect through this website and in connection with our sales, service, financing, and marketing activities, how we use and share it, and the choices and rights you have.

By using this website, you agree to the practices described in this Policy. If you do not agree, please do not use the site.

1. Who this Policy covers

This Policy applies to information we collect on this website and through related online and offline interactions with FDG and its dealerships. It does not apply to third-party websites we link to (including our manufacturers’ sites, lender sites, or dealership-branded sites hosted elsewhere), which have their own privacy policies.

2. Information we collect

Information you provide to us directly, for example when you:

  • Submit a contact, quote, test-drive, or “request more information” form on a vehicle
  • Apply for financing or pre-qualification, or submit a credit application
  • Schedule a service or parts appointment
  • Request a trade-in valuation
  • Opt in to receive text messages (see Section 4)
  • Sign up for email updates, price-drop alerts, or saved-search notifications
  • Leave a review or respond to a survey
  • Apply for a job or contact us with a question

This may include your name, email address, phone number, mailing address, the vehicles or offers you’re interested in, trade-in details, and — if you apply for financing — information required to process credit, which can include your date of birth, Social Security number, income, and employment information.

Information we collect automatically when you use the site, through cookies and similar technologies:

  • Device and connection details (IP address, browser type, operating system, device identifiers)
  • Pages and vehicles you view, searches you run, and vehicles you save to favorites or add to compare
  • Referring website, links clicked, and general usage/analytics data
  • Approximate location derived from your IP address

  • Our customer relationship management (CRM) and lead-routing systems

Categories of personal information (California). Depending on your interactions, the categories of personal information we collect include: identifiers; customer records (such as contact and financial-application information); commercial information (vehicles and services you inquire about or purchase); internet and network activity; approximate geolocation; and, where you apply for financing, sensitive personal information such as a Social Security number and financial-account information.

3. How we use your information

We use personal information to:

  • Respond to your inquiries and provide quotes, vehicle information, and service
  • Process financing applications and complete transactions
  • Schedule and provide sales, service, and parts support
  • Send you marketing communications, offers, and updates you’ve asked for
  • Send text messages you have opted in to receive (see Section 4)
  • Operate, personalize, secure, and improve the website (including remembering saved and compared vehicles)
  • Measure advertising and website performance
  • Detect and prevent fraud, and maintain the security of our systems
  • Comply with legal obligations and enforce our terms

4. Text messaging (SMS)

If you provide your mobile number and opt in, FDG and its dealerships may send you text messages related to your inquiry, appointment, or the offers you requested.

  • Consent is not a condition of purchase. You do not have to agree to receive marketing texts to buy or lease a vehicle or obtain service.
  • Message frequency varies based on your interactions.
  • Message and data rates may apply, depending on your mobile plan.
  • To stop, reply STOP to any message. For help, reply HELP or contact us using the details in Section 14.
  • We do not share mobile opt-in information with third parties for their own marketing.

5. Cookies and tracking technologies

We and our providers use cookies, pixels, tags, and similar technologies to run the site, remember your preferences and saved vehicles, understand how the site is used, and deliver and measure advertising. Some of this activity may be considered “sharing” or a “sale” of personal information under California law (see Section 7).

You can control cookies through your browser settings, and you can opt out of certain advertising cookies through industry tools such as the Digital Advertising Alliance (optout.aboutads.info) and the Network Advertising Initiative (optout.networkadvertising.org). We do not sell your information for money. We may share personal information with:

  • Service providers who operate the website, CRM, communications, analytics, and hosting on our behalf
  • Lenders and financial institutions to process financing you request
  • Vehicle manufacturers for programs, incentives, warranty, and recall purposes
  • Advertising and analytics partners (this activity may qualify as “sharing”/”sale” under California law; see Section 7)
  • Legal and safety recipients when required by law or to protect our rights, customers, or the public
  • In a business transfer, such as a merger, acquisition, or sale of assets

7. Your privacy choices and rights

Marketing choices. You can unsubscribe from marketing emails using the link in any email, reply STOP to text messages, or contact us to update your preferences.

California residents (CCPA/CPRA). If you are a California resident, you have the right to:

  • Know / access the personal information we’ve collected about you
  • Delete personal information we’ve collected, subject to exceptions
  • Correct inaccurate personal information
  • Opt out of the “sale” or “sharing” of your personal information
  • Limit the use of sensitive personal information
  • Not be discriminated against for exercising your rights

To submit a request, contact us using Section 14. You may also submit a “Do Not Sell or Share My Personal Information” request there or by enabling GPC in your browser. We will verify your request and may ask for information to confirm your identity. You may use an authorized agent to submit a request on your behalf with proper authorization.

Other states. If you reside in a state with its own consumer privacy law, you may have similar rights; contact us to exercise them.

8. Financial information

When you apply for financing, we handle the information you provide in accordance with the federal Gramm-Leach-Bliley Act (GLBA) and the FTC Safeguards Rule, and any separate financial privacy notice we provide at the time of application governs that information.

9. Data retention

We keep personal information for as long as needed to provide our services, complete the transactions you request, comply with our legal and recordkeeping obligations, resolve disputes, and enforce our agreements.

10. Data security

We maintain administrative, technical, and physical safeguards designed to protect personal information. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.

11. Children’s privacy

This website is not directed to children under 16, and we do not knowingly collect personal information from children. If you believe a child has provided us information, please contact us and we will delete it.

12. Third-party links and services

Our site may link to third-party websites and services, including our manufacturers, lenders, and dealership-branded sites. We are not responsible for their privacy practices; please review their policies.

We may update this Policy from time to time. When we do, we’ll revise the “Last updated” date above, and material changes will be reflected on this page.
